Please read these Terms and Conditions carefully. They relate to your use of the Council’s car parks.

1. Definitions

When the following words are used in these Terms and Conditions (the “Terms”), this is what they will mean:

“Business Day”: a day other than a Saturday, Sunday or public holiday in England, when banks in London are open for business

“Car Park” means any of the car parks you are permitted to park at by the Council.

Council” means Stevenage Borough Council of Daneshill House, Danestrete, Stevenage, Herts, SG1 1HN.

“Effective Date”: means the date the customer purchases a Season Ticket.

“Opening Hours” means the hours specified by any given Car Park you are authorised to park in.

“Season Ticket” the card issued by the Council to you to enter the Council’s car parks

“Service” has the meaning

2. Description of the Services

2.1 The Council will supply you with a Season Ticket free of charge from the Effective Date. The Season Ticket must be returned in accordance with clause 6.1 and be used in accordance with these Terms.

2.2 The Season Ticket will remain the property of the Council at all times, if your Season Ticket is lost, stolen, faulty or damaged the conditions at clause 6 will apply.

2.3 The Season Ticket is valid at the Council’s Car Park’s Monday to Sunday (inclusive).

2.4 You may only park in the Car Park’s permitted by the Council. This may be varied from time to time at the Council’s absolute discretion.

2.5 The Season Ticket is non-transferable and may only be used by you.

2.6 The Season Ticket does not guarantee you a parking space at any of the Council’s Car Parks.

2.7 The price of the Season Ticket is reviewed by the Council annually. The Council will provide you with 28 days’ notice of any change to the price.

3. Your Obligations

3.1 Your vehicle must be parked in a marked bay within the Car Park. Failure to do so may result in termination in accordance with Clause 8.3.

3.2 You must comply with the conditions at Schedule 1 of these Terms. Failure to do so may result in termination in accordance with Clause 8.3.

3.3 You must have a valid UK driver’s licence when entering and exiting a car park.

4. Suspension of Service

4.1 You may request that your Season Ticket be suspended for a period of not more than 6 months. Acceptance of any request to suspend is at the Council’s sole discretion.

4.2 You will pay charge of £36 inclusive of VAT to suspend the Service; this charge is reflective of the administration costs in de-activating and re-activating your Season Ticket.

4.3 You must provide the Council 14 days’ notice before the next direct debit payment is due.

4.4 For the avoidance of doubt Clause 6.1 does not apply to any suspension of the Service.

5. Payment

5.1 Payment is taken on the first working day of the calendar month by direct debit.

5.2 At your request the Council will provide you with previous receipts by email. Please provide an email address to the Council if you would like to receive copies of previous invoices.

6. Additional Charges

6.1 At the termination of the Terms, and within seven days you must return the Season Ticket to the Council at your cost. Failure to return will a £36 charge payable by you.

6.2 The Council will charge you thirty-six pounds (£36) for the replacement of lost or stolen Season Tickets.

6.3 The Council will replace a damaged or faulty Season Ticket:

6.3.1 Free of charge if you return the Season Ticket to the Council;

6.3.2 Otherwise for a fee of thirty-six pounds (£36).

7. Limitation of Liability

The Council will not accept any liability whatsoever in respect of the theft, loss or damage to any vehicle or its contents in the Council’s car parks. Nor will it accept any such liability in respect of damage caused by the malfunction of any automatic barrier or other equipment.

8. Duration and Termination

8.1 The Terms shall commence on the Effective date and shall continue, unless terminated earlier in accordance with its terms, until you return the Season Ticket to the Council and provide the Council not less than 14 clear days’ notice to terminate. Refunds will be calculated by the pro rata month/s remaining after the notice period.

8.2 The Council may terminate the Terms on 14 days’ notice.

8.3 If you do not comply with these Terms, the Council may without prejudice to any other remedy available to the Council, terminate the Terms without notice.

8.3.1 On Termination the Council will cancel any future direct debits payable by you. You will not be entitled to a full or partial refund for the remainder of the calendar month.

9. Data Protection

The Council shall comply with its data protection obligations as set out in the Council’s policies. Data held regarding the season ticket will be covered by the Council’s GDPR policies.

10. Assignment

These Terms are personal to you and you shall not assign, transfer or delegate in any other manner with any of the rights and obligations held by you under these Terms.

11. Notice

11.1 Any notice given to the Council under or in connection with these Terms shall be in writing and shall be delivered either:

(a) By hand or by pre-paid first-class post at its registered office; or

(b) By email

11.2 Any notice shall be deemed to have been received:

(a) if delivered by hand at the time the notice is left at the Council;

(b) if sent by pre-paid first class post at 11am on the second Business Day after posting

(c) if sent by email at the time of transmission, or, if this time falls outside the Council’s usual business hours, when business hours resume.

11.3 This clause does not apply to the service of any proceedings or other documents in any legal action or, where applicable, any arbitration or other method of dispute resolution.

11.4 Any notice given to you under or in connection with these terms shall be by email.

By purchasing a Season Ticket you agree to be bound by these Terms.

Schedule 1- Instructions for Use

When approaching the barrier please hold the season ticket up against the sensor, holding it still to give the computer time to read the information on the ticket. You should always do this even if the barriers are already raised. Failure to enter or exit without doing this will result in a ‘wrong presence’ and will cause you problems getting in and out in the future.
