Car Park Season Pass Terms and Conditions
Please read these Terms and Conditions carefully. They relate to your use of the Council’s car parks. By purchasing a Season Pass you agree to be bound by these Terms.
1. Definitions
When the following words are used in these Terms and Conditions (the “Terms”), this is what they will mean:
“ANPR” means Automatic Numberplate Recognition System and is the camera system used to control access to the car parks
“Business Day”: a day other than a Saturday, Sunday or public holiday in England, when banks in London are open for business.
“Car Park” means any of the car parks you are permitted to park at by the Council
“Council” means Stevenage Borough Council of Daneshill House, Danestrete, Stevenage, Herts, SG1 1HN.
“Effective Date”: means the date the customer purchases a Season Pass
“Opening Hours” means the hours specified by any given Car Park you are authorised to park in.
“Season Pass” means registration on the Council’s ANPR system to allow users to access car parks free at the point of use
“Service” has the meaning set out in section 2 below
2. Description of the Services
2.1 Purchase of a Season Pass will grant you access to the Council’s car parks by registering your vehicle registration number on a database. Your vehicle will be identified by the ANPR system and will enable you to enter and exit the car park without having to pay at the point of use.
2.2 Season Passes are valid at the Council’s Car Parks Monday to Sunday (inclusive).
2.3 You may only park in the Car Park’s permitted by the Council. This may be varied from time to time at the Council’s absolute discretion.
2.4 The Season Pass does not guarantee you a parking space at any of the Council’s Car Park’s.
2.5 The price of the Season Pass is reviewed by the Council annually. The Council will provide you with 28 days’ notice of any change to the price.
2.6 You will provide at least 48hrs notice of any amendments to entries on the ANPR database.
2.7 You may register up to two vehicle registration numbers on the database for each season pass. If you register two vehicles, the season pass will only work for one of these vehicles at a time.
3. Your Obligations
3.1 Your vehicle must be parked in a marked bay within the Car Park. Failure to do so may result in termination in accordance with clause 7.3.
3.2 You must comply with the conditions at Schedule 1 of these Terms. Failure to do so may result in termination in accordance with clause 7.3.
3.3 You must have a valid UK driving licence when entering and exiting a Car Park.
3.4 Vehicles using the car parks must have a current MOT and Road Fund Licence
4. Suspension of Service
4.1 You may request that your Season Pass be suspended for a period of not more than 6 months. Acceptance of any request to suspend is at the Council’s sole discretion.
4.2 You will pay charge of £36 inclusive of VAT to suspend the Service; this charge is reflective of the administration costs in de-activating and re-activating your Season Pass.
4.3 You must provide the Council 14 days’ notice before the next direct debit payment is due.
4.4 For the avoidance of doubt clause 7.1 does not apply to any suspension of the Service.
5. Payment
5.1 Payment is taken on the first working day of the calendar month by direct debit.
5.2 Please provide an email address to the Council if you would like to receive copies of previous invoices.
6. Limitation of Liability
The Council will not accept any liability whatsoever in respect of the theft, loss or damage to any vehicle or its contents in the Council’s car parks. Nor will it accept any such liability in respect of damage caused by the malfunction of any automatic barrier or other equipment.
7. Duration and Termination
7.1 The Terms shall commence on the Effective date and shall continue, unless terminated earlier in accordance with its terms. We require not less than one-month notice to terminate. The Council does not refund partial months.
7.2 The Council may terminate the Terms on 14 days’ notice.
7.3 If you do not comply with these Terms, the Council may without prejudice to any other remedy available to the Council, terminate the Terms without notice.
7.4 On Termination the Council will cancel any future direct debits payable by you. You will not be entitled to a full or partial refund for the remainder of the calendar month.
8. Data Protection
The Council shall comply with its data protection obligations as set out in the Council’s policies. Data held regarding the season ticket will be covered by the Council’s GDPR policies.
9. Notice
9.1 Any notice given to the Council under or in connection with these Terms shall be in writing and shall be delivered either:
a. By hand or by pre-paid first-class post at its registered office; or
b. By email
9.2 Any notice shall be deemed to have been received:
a. if delivered by hand at the time the notice is left at the Council.
b. if sent by pre-paid first class post at 11.00 am on the second Business Day after posting.
c. if sent by email at the time of transmission, or, if this time falls outside the Council’s usual business hours, when business hours resume.
9.3 This clause does not apply to the service of any proceedings or other documents in any legal action or, where applicable, any arbitration or other method of dispute resolution.
9.4 Any notice given to you under or in connection with these terms shall be by email.
Schedule 1- Instructions for Use
When approaching the barrier please drive slowly and be prepared to stop to give the camera time to read your number plate.
If the camera reads your plate correctly the barrier will raise to let you in and on exiting the barrier will raise to let you out.
If the camera fails to read your number plate on entering, the machine will issue you with a ticket inviting you to pay before leaving. In this case, on exiting, please do not pay but press the intercom button, state that you are a season ticket holder and ask to be let out.
