When do I need Building Regulation Approval?
You need Building Regulation Approval when you:
- erect a building;
- extend a building;
- alter a building, e.g. carry out structural alterations;
- carry out a 'change of use' of certain buildings;
- alter or extend a controlled service, e.g. install a toilet or handbasin;
- are installing most electrical working involving external electrics
What is 'Change of Use'
‘Change of use' is when a building is used as:
- a dwelling when previously it was not;
- a hotel or institution when previously it was not;
- a public building e.g. school, theatre, hall, church etc when previously it was not.
Which building work is exempt from Building Regulation Approval
Building work exempt from Building Regulation Approval is as follows:
An extension which is a ground floor extension having a area not exceeding 30m2 and comprising of a:
- conservatory;
- porch;
- carport, provided it is open on two sides;
- veranda, loggia or covered way.
A single storey detached building provided it:
- Contains no sleeping accommodation and where the floor area is less than 15m2 (internal measurements.
- It can be constructed with any material, or if the floor area is greater than 15m2 and less than 30m2.
- It should be sited at least 1m from the boundary, unless it is constructed of substantially non-combustible materials then it can be sited nearer to the boundary.
Greenhouses unless they are used for retailing or exhibiting.
- Note that any electrical installation to an exempt building may be controllable and you may need to make an application for the electrical work unless a 'competent person' supervises the work.
Agricultural Buildings (including those used for horticultural, fruit growing, the growing of plans for seed and fish farming, but not those used for retailing, packing or exhibiting) provided that:
- No part of the building is used as a dwelling
- No part of the building is less than one and a half times its height from any part of a building which contains sleeping accommodation.
- The building is provided with a fire exit not more than 30 metres from any point within the building.
Temporary Buildings - provided they do not remain where erected for more than 28 days.
I need Building Regulation Approval - what do I do next?
If you think you need Building Regulation Approval there are two ways to apply:
Full Plans or give a Building Notice
Is there a fee payable?
The Council will make a charge for their services, unless the work is for the provision of facilities for a disabled person. A schedule of charges is available on request.
When can I start work?
Full Plans - you do not have to wait until your plans are approved before starting work, although with an approval you do have protection against unnecessary costs.
Building Notice - You can start work 2 days after giving notice.
What happens if I do not submit an application?
If you proceed with the work without applying you are contravening the Building Regulations.
