Hedgerow Removal Notice

If you wish to remove a particular hedgerow, or part of a hedgerow, you may need to complete the Hedgerow Removal Notice to comply with the regulations. These regulations are designated to protect important hedgerows in England and Wales. However, the Hedgerow Removal Notice is only required if it has been protected under The Hedgerows Regulations 1997. You can contact us to find out whether or not your hedgerow is protected under the Regulations.

Hedgerow: is not separately defined in section 97 of the Environment Act 1995 or in the Regulations. However, the Oxford English Dictionary (2nd Edition, 1989) states that it is a “row of bushes forming a hedge, with trees, etc. growing in it”.

Remove: the term removed defined in section 97(8) of the 1995 Act as ‘uproot or otherwise destroy’. A judgement on whether the proposed works or other activity constitutes the removal will be made according to the circumstances of the individual case.
